Senate Dems divided over cuts to benefit programs

(AP) ? Deep divisions among Senate Democrats over whether cuts to popular benefit programs like Medicare and Medicaid should be part of a plan to slow the government's mushrooming debt pose a big obstacle to a deal for avoiding a potentially economy-crushing "fiscal cliff," even if Republicans agree to raise taxes.

Much of the focus during negotiations seeking an alternative to $671 billion in automatic tax increases and spending cuts beginning in January has centered on whether Republicans would agree to raising taxes on the wealthy. President Barack Obama has insisted repeatedly that tax increases on the wealthy must be part of any deal, even as White House officials concede that government benefit programs will have to be in the package too.

"It is the president's position that when we're talking about a broad, balanced approach to dealing with our fiscal challenges, that that includes dealing with entitlements," White House press secretary Jay Carney said Tuesday.

But even if GOP lawmakers agree to raise taxes, there is no guarantee Democrats can come up with enough votes in the Senate to cut benefit programs ? as Republicans are demanding.

"I hope not if it means Social Security or Medicare benefit cuts," said Sen. Sheldon Whitehouse, D-R.I.

There's a growing consensus among Senate Democrats and the White House that Social Security should be exempt from any deficit-reduction package. But some centrist Democrats in the Senate argue that fellow Democrats must be willing to consider cuts to Medicare and Medicaid in order to get concessions from Republicans on taxes.

"It has to be both ? a significant revenue increase as well as spending cuts," said Sen. Max Baucus, D-Mont., chairman of the Senate Finance Committee.

Sen. Kent Conrad, D-N.D., who is retiring as chairman of the Senate Budget Committee, said rising health care costs in Medicare and Medicaid are helping to drive future spending, making them an essential part of a long-term deficit-reduction package.

"I've been part of every bipartisan group here. We've always put everything on the table," Conrad said. "If you're going to solve this problem, you're going to have to deal with where the spending is and the revenue can be raised."

But senators like Baucus and Conrad increasingly are being drowned out by other Democrats emboldened by the recent election results to fight against benefit cuts.

Sen. Tom Harkin, D-Iowa, said he is willing to find savings in Medicare and Medicaid by making them more efficient. But, he said, he won't support benefit cuts.

"I think the election spoke very strongly about the fact that the vast majority of American people don't want to cut these programs," Harkin said.

Congress and the White House are devoting the next three weeks to finding at least a bridge over the fiscal cliff by reducing the sudden jolt of higher taxes and spending cuts in January while laying a framework for addressing the nation's long-term financial problems next year.

Obama wants to let tax rates rise for wealthy families while sparing middle- and low-income taxpayers. Some Republican leaders, including House Speaker John Boehner of Ohio, have said they were willing to consider making the wealthy pay more by reducing their tax breaks. But most Republicans in Congress adamantly oppose raising anyone's tax rates.

Negotiations are going slowly as each side waits for the other to make concessions.

Democrats already have tried to take Social Security off the table. Carney, the White House spokesman, said Monday that changes to the massive retirement and disability program should be done separately from any plan to reduce the deficit. That's the same position taken by 28 Democratic senators and independent Sen. Bernie Sanders of Vermont in a letter to fellow senators in September.

"We will oppose including Social Security cuts for future or current beneficiaries in any deficit-reduction package," said the letter, which was signed by many top Democrats, including Majority Leader Harry Reid of Nevada. In the House, Democratic leader Nancy Pelosi has taken the same position, not only on Social Security, but also on Medicare and Medicaid.

"There hasn't been the slightest suggestion about what they're going to do about the real problems, and that's entitlements," said Sen. Orrin Hatch of Utah, the top Republican on the Senate Finance Committee. "There's a certain cockiness that I've seen that is really astounding to me since we're basically in the same position we were before" the election.

The No. 2 Senate Democrat, Dick Durbin of Illinois, has tried to find common ground, saying he would be willing to require wealthy seniors to pay more for Medicare benefits. But on Tuesday, he said those discussions shouldn't be part of rushed negotiations to avoid the fiscal cliff.

"If we simply stand by and say 'don't touch Medicare in any way, for any reason, ever' we are inviting a crisis that opponents can exploit to eviscerate Medicare or even to end it," Durbin said. "Progressives should be willing to talk about ways to ensure the long-term viability of Social Security, Medicare and Medicaid, but those conversations should not be part of a plan to avert the fiscal cliff."

Mountain biking trail network at Dewey Mountain Recreation Area in ...

Town of Harrietstown officials got an update Thursday on the ongoing construction of a network of mountain biking trails at the town-owned Dewey Mountain Recreation Area. ?The good news is we?ve built a lot of trail,? Chris Gosling of the Barkeater Trails Alliance, or BETA, told the town board. ?We?ve had a lot of great volunteer work days, and we?ve had a great season.?

Gosling gave the board a color-coded map that showed the trails that have already been built, ones that are currently being developed and trails planned in the future. BETA member Leigh Walrath said there are now about 5 miles of mountain biking trails at Dewey, with plans to hopefully build another 2 to 3 miles.

Gosling said he?s already seeing signs that Dewey is becoming a popular mountain biking spot. ?We?re at a point where ridership is up,? Gosling said. ?We?re starting to see a lot more people on the trails. Traditionally in the summer the mountain hasn?t gotten a lot of use, but we?re seeing people out there all the time.

?The other thing is with the addition of some of these new trails, we?re finally to the point where we?re not a destination but we?re a worthwhile location to go for a ride. Local riders no longer have to drive to Lake Placid or Wilmington or another community. We have enough right here at home.?

Gosling also spoke with the board about the possibility putting on a race at Dewey and village-owned Mount Pisgah, where volunteer crews have also been building mountain biking trails. Councilman Ron Keough raised the idea at the board?s Oct. 11 meeting and Gosling was invited to speak about it. ?I thought it would be a good thing to do,? Keough said, ?a way to bring people in who enjoy that kind of activity and enhance both Dewey and Pisgah.?

Gosling said he likes the idea, but he said the amount of mileage at the two mountains isn?t enough to put on a race at this point. He also said his organization wants to focus on building mountain biking trails, not organizing races. However, Gosling said that doesn?t mean Dewey couldn?t host some mountain biking-related events.

He suggested developing informal races, like the Thursday night running races in the summer, or social gatherings like the Dewey Mountain Ski Jams in the winter, ?something that?s designed for the local communities and will get people out to the mountain.?

Hosting a dual-sport event like mountain biking and road biking, or mountain biking and trail running, is also a possibility. Gosling said another BETA member suggested hosting a 3-stage race over a weekend, with one stage each in Saranac Lake, Lake Placid and Wilmington. ?That would be something that would bring people to the area, and between the three communities we feel we have enough terrain that it would be a viable option,? Gosling said.

If the town wants to pursue hosting a race, Gosling suggested the board talk with Jason Smith and Steve Doxzon of Adirondack Lakes and Trails Outfitters, who manage Dewey for the town, or the two bike shops in Lake Placid: Placid Planet and High Peaks Cyclery.

Gosling said mountain biking advocates in the area are also working to get new trails added to state land that?s part of the Saranac Lake Wild Forest. Members of BETA and officials from the town and village met with representatives of the state Department of Environmental Conservation this week to discuss that topic. ?Demand for bicycling as a sport is growing incredibly,? Gosling said. ?People are looking for places to go. We see this as a great opportunity for the area to be able to attract people who otherwise wouldn?t be coming.?

Town officials thanked Gosling and BETA for their efforts. ?I think what you guys are doing is great, and I give you huge kudos,? said Councilwoman Nichole Meyette.

On Thursday, in an on-line opinion piece on Bloomberg.com, the Democrat-turned-Republican-turned-Independent said hurricane Sandy had ?brought the stakes of Tuesday?s presidential election into sharp relief.?

Exactly what does that mean?

In a few words, it means he is endorsing President Obama.

Cynics might say Mayor Bloomberg is thinking of who can get him the most aid to fix up New York after the devastation from the storm. Certainly New York will be asking Mr. Obama or whoever is president to pay a tab that will certainly stretch into the billions and billions of dollars.

But, that?s not what Bloomberg says made him decide to support Obama.

One of Bloomberg?s major concerns as mayor for the past 11 years has been global warming. He?s tried to lower New York City?s carbon footprint by planting more trees, getting more people to ride bikes, and looking for alternative energy supplies for one of the nation?s largest consumers of power.

From Bloomberg?s viewpoint, Obama has marched in the same direction by setting higher fuel-efficiency standards for cars and trucks, tightening controls on mercury emissions, and closing the dirtiest coal plants.

There was a time when Republican Mitt Romney was just as concerned about global warming, says Bloomberg. As governor of Massachusetts, Romney signed into law a regional cap-and-trade plan designed to reduce carbon emissions to 10 percent below 1990 levels.

Mr. Romney says he is still worried about the environment. But, as far as Bloomberg is concerned, he has ?reversed course,? abandoning the cap-and-trade program he once supported.

Bloomberg says that?s not his only problem with Romney. He disagrees with the governor?s current views on abortion, Obamacare, and marriage equality for lesbians and gay men.

In another example of Bloomberg supporting people who agree with him, he has endorsed Sen. Scott Brown (R) of Massachusetts in his battle against Democrat Elizabeth Warren because of his stance on gun control. Senator Brown opposes a National Rifle Association bill that would have made it legal for someone who lives in a state with weak gun control laws to carry a concealed weapon in states like New York that have tough laws.

This is not to say Bloomberg is overjoyed with Obama.

?As president he devoted little time and effort to developing and sustaining a coalition of centrists, which doomed hope for any real progress on illegal guns, immigration, tax reform, job creation and deficit reduction,? he writes. ?And, rather than uniting the country around a message of shared sacrifice, he engaged in partisan attacks and has embraced a divisive populist agenda focused more on redistributing income than creating it.?

In fact, Bloomberg says he could have voted for the 1994 and 2003 versions of Romney because ?I have found the past four years to be, in a word, disappointing.?

Disappointment aside, he?s voting for Obama.

Remember how Apple got called out by a UK judge for basically being a dick when it "apologized" by saying the Samsung Galaxy Tab 10.1 didn't "infringe" but still "willfully copied" the iPad? Yeah. Those were good times. Apple's revised advert is appearing in British papers today (please let it be on Page 6!), and it's a snoozer. It's a 87 words (or something like that -- we fell asleep) of pure legal drivel. But at least it's more in the spirit of what the judge intended, we suppose. Have a cup of coffee, and have a read. Then pour another cup.

(And in related news, it seems the earlier "non-compliant" statement has now been pulled from Apple's UK site -- go figure.)

Super-rare, super-luminous supernovae are likely explosion of universe's earliest stars

ScienceDaily (Nov. 1, 2012) ? The most-distant, super-luminous supernovae found to date have been observed by an international team, including Raymond Carlberg of the University of Toronto's Department of Astronomy & Astrophysics. The stellar explosions would have occurred at a time when the universe was much younger and probably soon after the Big Bang.

"The objects are both unusually bright and unusually slow to fade. These are properties that are consistent with what is known as pair-instability supernova, a rare mechanism for explosion which is expected to happen for high-mass stars with almost no metal content. That is, the very first stars to form," said Carlberg.

The two supernovae, identified as SN2213 and SN1000+2016, were discovered in image data obtained via the Canada-France-Hawaii Telescope Legacy Survey. In recent years, various surveys have enabled astronomers to open new windows on the universe, including the discovery over the past decade of super-luminous supernovae that are tens to hundreds of times more luminous than regular supernovae. "The Canada-France-Hawaii Telescope Legacy Survey stands out as the first really deep survey of the sky, covering large volumes of the universe," said Carlberg, a Canadian leader of the Survey.

All of the processing of the image data was done at U of T using a search technique that first vastly narrows the search to the high redshift star-forming galaxies and then looks for supernovae that are more luminous than normal supernovae and have unusually long fading times -- precisely the characteristics of pair-instability supernovae.

The pair-instability explosion mechanism only occurs in stars that are about 150-300 times more massive than the sun, explains Carlberg. No stars that massive form in the current universe because as stars are assembled they start nuclear burning and push away additional gas. However, in the very early days of the universe, the metal abundance of the gas is essentially zero, making it almost transparent so that it can fall on the forming star.

Such massive stars do not last long. They are so hot in the centre that pressure is lost causing a collapse to start, which then heats up the core even more. Eventually enough oxygen and silicon are created that their fusion causes a nuclear explosion much more luminous than other supernova mechanisms.

Spooky name surrounds former Chesterfield town - NBC12.com ...

CHESTERFIELD, VA (WWBT) -

If you're looking for an eerie sounding location to check out on Halloween you may not have to travel very far at all. In fact, a social media application lists an ?area in Chesterfield County as the vanishing town of Screamersville.

"When I send recent text messages or check-in, like you can on Facebook, the destination that you send from always says Screamersville and I always wondered why," said Mark Umphry.

He lives in Enon, right next to one of the historic graveyards.

"It's kind of in a creepy spot. It's been there for years," he said.

Turns out, tombstones identify freed slaves from the post Civil War era who settled in the town. The area is located along Route 10 near I-295.

Diana Dallmeyer with the Chesterfield Historical Society explains how Screamersville got its name.

"These were people who lived hard lives. They were extremely poor. They learned how to party and make the best of the circumstances that they had, so a lot of screaming and revelry going on. That's one theory," Dallmeyer said.

She says there are several theories behind the name.

"The lack of modern conveniences like telephones, other ways of communication. People just hollered from porch to porch greeting their neighbors and communicating," she suggested.

Today the former community is replaced with modern houses and condos but the few graveyards that remain shed light into another theory.

"One theory is that these are the residents of the cemetery expressing themselves," Dallmeyer said.

Whatever the case, it is perhaps the only preservation of a town with a spooky name that used to be.

"The most we can do is try to record these fascinating nuggets of our county's history," she said.

"I never hear any screams though," Umphry said with a laugh.

Screamersville, Virginia also has a Facebook page where many have checked-in and are talking about on their personal pages.

The Galaxy are in Major League Soccer?s playoff doghouse ? Thursday?s 90-minute mid-week eliminator contest before the ?real? post-season series begin ? based on that limping dog of a spring.

The star-strewn Galaxy was shockingly awful to start its 2012 MLS Cup title defense, a pitiful excuse for a reigning champ that slogged out of May with a frown and a 3-8-2 record (and having been eliminated from U.S. Open Cup play by the ? Carolina Red Hawks?). But Bruce Arena and the boys got their stuff together, and now ?

This does not look a thing like some fourth-place outfit ? and no one will be surprised if the Western Conference?s most high-profile assembly of known names ?upsets? its way right into a second consecutive MLS Cup.

  • Galaxy captain and U.S. all-time leading scorer Landon Donovan got back on the field for the Galaxy?s season finale after missing almost a month due to a knee injury. He had a team-high 14 assists.

  • David Beckham ? Perhaps you?ve heard of him? ? remains the league?s top passer over long distance and still has the best free kick strikes in the game. That makes any set piece in the Galaxy?s final third a moment to scoot up on the seat and pay special attention. If Beckham isn?t feeling the shot, he?ll aim for the 6-5 Gonzalez.
  • Mike Magee should make most people?s All-Underrated Best XI. He?ll appear out of the Galaxy midfield, his smart runs helping to create chances, especially when parlayed with Robbie Keane?s sophisticated, active movement in and around the opposition penalty area. Keane, the longtime Irish international, was team MVP with 16 goals and 9 assists.
  • The Galaxy?s weak link? Rookie center back Tommy Meyer, filling in for the injured A.J. De La Garza, will be playing in his biggest match to date.

On the Vancouver Whitecaps:

  • The Whitecaps slid into the playoffs, essentially, because Dallas was too far behind and then failed to pick up points in two late matches over Chivas USA. So, fifth place to the ?Caps!
  • Martin Rennie?s men beat Real Salt Lake back on Aug. 11 ? and pretty much stunk up the place from there. They won once over the last 10 regular season matches, and that came courtesy of the West?s worst side, poor ol? Chivas USA.? The Whitecaps were shut out in seven of those contests.
  • The club?s pair of pricey Scottish internationals, Barry Robson and Kenny Miller, have largely failed to deliver. Robson, the team?s attacking midfielder, does continue to look threatening, at least, and seems to have something to offer if only in drive through the center of the park and emotion. Miller? Not so much. There?s even a question of whether he will start. (Robson and Miller both spent most of the season finale on the bench.) Rookie dynamo Darren Mattocks and speedy Dane Richards, who is usually stationed out wide, gives Rennie that option.
  • Vancouver?s road form will not do much to inspire confidence. The Whitecaps have just one victory away from BC Place since April, than against Colorado, which finished 7th in the West. The ?Caps are 1-9-3 away since that early, short burst of road success.
  • Scoring goals has mostly been the issue. In the back, former U.S. international Jay DeMerit has been terrific. So has right back Young-Pyo Lee. Whitecaps fans (they call him ?Y.P. Lee?) voted him 2012 Player of the Year.

Bottom line:

The Galaxy is heavy favorite, with good reason. The current champs, holder of a huge edge in big-game experience and comfy at home, would win this contest seven times out of eight.

Of course, there?s always the one. Otherwise, why even bother to play the darn thing?

Cleveland Clinic Medical Innovations Of 2013 Include Headache ...

Oct 31 (Reuters) - The best medical innovations for next year include an almond-size device that's implanted in the mouth to relieve severe headaches and a hand-held scanner resembling a blow dryer that detects skin cancer, the Cleveland Clinic said on Wednesday.
The clinic's annual list of the best medical innovations for 2013 also includes new drugs to treat advanced prostate cancer and better mammography technology.
But leading the 2013 list for innovations is an old procedure that has a new use due to findings in a recent study. Physicians and researchers at the clinic voted weight-loss surgery as the top medical innovation, not for its effectiveness in reducing obesity, but for its ability to control Type 2 diabetes, the most common form of the disease.
Over the years, bariatric surgeons noticed that the procedure would often rid obese patients of Type 2 diabetes, before they even left the hospital.
A study, led by Cleveland Clinic head of Bariatric and Metabolic Institute Dr. Philip Schauer, examining this phenomenon was published in the prestigious New England Journal of Medicine earlier this year.
" Bariatric surgery has been around for a while. The reason it was chosen as the top innovation is because Medicare has broadened its indication for payment, and Medicaid in many states follows Medicare. A lot of the other (private) insurance companies started covering it, so it's much more accessible," Dr. Michael Roizen, the Cleveland Clinic's Chief Wellness Officer, said in an interview.
The criteria that insurers use to cover the surgery has been broadened because of its effectiveness in controlling Type 2 diabetes, he said.
The number of people affected by diabetes has tripled over the past 30 years to more than 20 million Americans, according to the Centers for Disease Control and Prevention, and more than 90 percent of those cases are Type 2.
Doctors and researchers at the Cleveland Clinic voted for what they thought were the biggest, most significant innovations from the 250 ideas submitted from their colleagues at the clinic. Roizen said one of the main contributing factors to getting on the list is the number of people that the product or procedure can potentially help.
For that reason, a device that helps relieve headaches, the second most common ailment after the cold, was second on the clinic's list.
The miniaturized device -- invented at the Cleveland Clinic and spun off into a separate, private company called Autonomic Technologies Inc -- is implanted in the upper gum above the second molar to treat cluster headaches and migraine headaches. A lead tip of the implant is placed near specific nerves behind the bridge of the nose.
When the patient feels the headache coming on, a remote control device is placed on the outside of the cheek and the device delivers stimulation to those nerves, blocking headache pain.
The implant is available in Europe, but not in the United States. The company needs to do more studies to get FDA approval, said Dr. Frank Papay, Department Chair of Dermatology and Plastic Surgery Institute at the Cleveland Clinic, and consultant to Autonomic Technologies.
A hand-held device used to detect melanoma, the most deadly form of skin cancer, was also on the list.
"Up until now, we've counted on our eyes," Dr. Allison Vidimos, Department Chair of Dermatology at the Cleveland Clinic, told Reuters. "This device offers an objective look underneath the skin using a special spectrum of light."
It compares moles and other things it finds on the patient's skin with a large database containing information on all types of melanoma. It also rates the risk.
"All dermatologists fear missing melanomas. The cure rate can be close to 100 percent if caught early," she said.
Vidimos said using the device, approved by FDA last year for use by trained dermatologists, helps prevent unnecessary biopsies.
Mela Sciences Inc <MELA.O and Verisante Technology Inc make the scanning device.
Also on the list is a new type of mammography, called breast tomosynthesis. This technology provides greater detail of the image than the standard mammography, which renders a 2-dimensional image.
For the patient, it may seem like there's no difference. "You still have the squish," said Dr. Alice Rim, Section Head of Diagnostic Radiology. But the images produced by the new technology show the breast in slices, so far more detail can be seen.
"With 2-demensional mammography, there are shadows, so it can be like a polar bear running around in a snow storm. This eliminates the shadows, allowing increased detection and fewer call backs (for a second mammography)," Rim said.
Other devices that made the list include mass spectrometry for bacterial infections, which allow microbiology laboratories to identify the type of bacteria sooner and with more specificity, a new modular stent graft to treat complex aortic aneurysm and a laser used for cataract surgery.
Novel drugs to treat advanced prostate cancer were on the clinic's list because of their ability to halt the progress of the disease by blocking testosterone receptors.
A new technique to repair and regenerate damaged lungs, called ex vivo lung perfusion, is on the list. Experts say as many as 40 percent of previously rejected donor lungs may now be suitable for transplantation after undergoing this novel "lung washing".
The procedure involves placing donor lungs into a bubble-like chamber connected to a cardiopulmonary pump and ventilator. Over four to six hours, the lungs are repaired as special fluids are forced through the blood vessels. Nutrients are used to recondition the lungs as they inflate and deflate.
The final item on the list is neither a procedure, a drug nor a device, but healthcare programs that use incentives to encourage people to take better care of themselves.
The Medicare Better Health Rewards Program Act of 2012 provides incentive payments to Medicare participants who voluntarily establish and maintain better health.
"We are seeing efforts to avoid rationing of healthcare and seeing programs with incentives built in if people maintain their health. This can radically change the cost of care," said Roizen. "We're seeing this more in big companies, the GE's and J&J's of the world. All companies are looking at how much they are spending on healthcare and they are looking at ways they can reduce spending without rationing."

In order to successfully progress in the game it is necessary to evolve from being a talented individual into being a great team player. Almost every successful professional player is fully aware how important the team is and structure their development around this.

A key benefit is tuition funding. For whatever reason some trainees drop out and those that continue also need to consider their future after the short playing career. One way participants benefit is by not building up the same sized debts that many other students accumulate.

A scholarship that includes college soccer training is an amazing opportunity. It offers the prospect of discovering the potential as a sportsman as well as providing funded higher education. Some of the best players can go on to become stars at club or even international level.

Dissident artist Ai Weiwei goes 'Gangnam Style'

Updated at 12:42 p.m. ET: BEIJING ? Released this past summer, Korean pop star Psy's "Gangnam Style" quickly became a global phenomenon. Within months, the infectious song has been watched over 530 million times and recently earned the distinction of being the most ?liked? video in YouTube history according to the Guinness Book of World Records.

It seems that everyone has tried to get in on the Gangnam rage, including Google's executive chairman Eric Schmidt, our very own TODAY team, and just this week, United Nations Secretary-General Ban Ki-Moon.?

Ai Weiwei, China?s dissident artist who was detained last year for nearly three months, on Wednesday became the latest to jump on the Gangnam bandwagon, uploading his own version of ?Gangnam Style? on YouTube. The video, which shows Ai dancing in handcuffs, is entitled "Grass Mud Horse Style." ?

"Grass Mud Horse," a homonym of a Chinese phrase that suggests a very lewd act with one?s mother, is popular among anti-censorship activists in China.

PSY, the South Korean pop singer whose "Gangnam Style" viral video sensation made him an international star, returns to his home country, where crowds are going wild. NBC's Ian Williams reports.

Ai told journalists that the idea to cover the dance craze came from one of the many donors who helped him out last year when Ai was ordered to pay back taxes that the government claimed that he owed. Donations to help pay Ai?s government fine flooded in online and supporters even visited his studio home in Beijing to toss money over the wall to him.

YouTube is banned in China and the video has not appeared on Chinese video sites.

The artist's tongue-in-cheek and at times hilarious -- at one point Ai can be seen swinging a pair of handcuffs around his head -- anti-censorship send-up may have been received with silence by Chinese state press, but it has been picked up by the New York Times,?the Washington Post?and?NPR.

The Grass Mud Horse, which has its origins in a 2009 collection of hoax entries in a popular Chinese web-based encyclopedia called Baidu Baike, became a popular and irreverent way to poke fun at the heavy-handed censorship of China?s ruling Communist Party.

Detroit-Area Physician, Home Health Agency Owner, and Patient ...

WASHINGTON?A federal jury in Detroit today convicted a physician, a home health agency owner, and a patient recruiter for their participation in a $14.5 million Medicare fraud scheme, announced Assistant Attorney General Lanny A. Breuer of the Justice Department?s Criminal Division; U.S. Attorney Barbara L. McQuade of the Eastern District of Michigan; Robert Foley III, Special Agent in Charge of the FBI Detroit Field Office; and Special Agent in Charge Lamont Pugh III of the HHS Office of Inspector General (HHS-OIG), Office of Investigations Detroit Office.

Dr. Pramod Raval, 59, was found guilty in U.S. District Court for the Eastern District of Michigan of one count of conspiracy to commit health care fraud and one count of conspiracy to solicit or receive health care kickbacks in exchange for referring patients to two Detroit area home health care companies, Patient Choice Home Healthcare Inc. and All American Home Care Inc.

Chiradeep Gupta, 38, a physical therapist and part-owner of All American, was found guilty of one count of conspiracy to commit health care fraud, one count of conspiracy to commit money laundering, and three substantive counts of money laundering.

Richard Shannon, 39, a patient recruiter, was found guilty of one count of conspiracy to commit health care fraud.

The defendants were charged in a superseding indictment returned March 27, 2012. Sixteen other individuals who worked at or were associated with Patient Choice and All American have previously pleaded guilty.

According to evidence presented at trial, the defendants and their co-conspirators caused the submission of false and fraudulent claims to Medicare through Patient Choice and All American, two home health care companies located in Oak Park, Michigan that purported to provide skilled nursing and physical therapy services to Medicare beneficiaries in the greater Detroit area.

The evidence showed that the defendants and their co-conspirators used patient recruiters who paid Medicare beneficiaries to sign blank documents for physical therapy services that were never provided and/or medically unnecessary. The owners of Patient Choice and All American paid physicians to sign referrals and other therapy documents necessary to bill Medicare. Physical therapists and physical therapist assistants provided through contractors would then create fake medical records using the blank, pre-signed forms obtained by the patient recruiters to make it appear as if physical therapy services were actually rendered, when, in fact, the services had not been rendered.

According to evidence presented at trial, Raval referred both patients from his own practice and patients brought into the scheme by recruiters to Patient Choice and All American in exchange for kickbacks. Gupta provided to Patient Choice and All American physical therapists and physical therapist assistants who created fake patient files using blank, pre-signed forms obtained by patient recruiters, to make it appear as if the physical therapy services billed to Medicare had actually been given. Gupta also doctored and directed the doctoring of fake patient files. The evidence at trial showed that Gupta laundered the proceeds of the fraud through multiple shell companies. Shannon paid patients in cash in order to obtain their signatures on blank physical therapy forms used to create fake therapy documents.

Vishnu Meda, a physical therapist assistant at Patient Choice and All American, was acquitted today of one count of conspiracy to commit health care fraud.

The case was prosecuted by Assistant Chief Gejaa T. Gobena and Trial Attorneys Catherine K. Dick and Niall M. O?Donnell of the Criminal Division?s Fraud Section. The investigation was led by the FBI and HHS-OIG, and was brought by the Medicare Fraud Strike Force, a joint effort of the U.S. Attorney?s Office for the Eastern District of Michigan and the Criminal Division?s Fraud Section.

Since its inception in March 2007, the Medicare Fraud Strike Force, now operating in nine cities across the country, has charged more than 1,480 defendants who have collectively billed the Medicare program for more than $4.8 billion. In addition, HHS?s Centers for Medicare and Medicaid Services, working in conjunction with HHS-OIG, is taking steps to increase accountability and decrease the presence of fraudulent providers.

(AP) ? When Hurricane Sandy becomes a hybrid weather monster some call "Frankenstorm" it will smack the East Coast harder and wider than last year's damaging Irene, forecasters said Friday.

The brunt of the weather mayhem will be concentrated where the hurricane comes ashore early Tuesday, but there will be hundreds of miles of steady, strong and damaging winds and rain for the entire Eastern region for several days, according to the National Oceanic and Atmospheric Administration.

The hurricane has killed at least 20 people in the Caribbean, and just left the Bahamas. It is expected to move north, just off the Eastern Seaboard.

As of Friday morning, federal forecasters were looking closer at the Delaware shore as the spot it will turn inland and merge with a wintry storm front. But there is a lot of room for error in the forecast and the storm could turn into shore closer to New York and New Jersey and bring the worst weather there.

Wherever Sandy comes ashore will get 10 inches of rain and extreme storm surges, Louis Uccellini, NOAA's environmental prediction director, said in a Friday news conference. Other areas not directly on Sandy's entry path will still get 4 to 8 inches of rain, maybe more, he said. Up to 2 feet of snow should fall on West Virginia, with lighter snow in parts of Ohio and Pennsylvania, regardless of where Sandy first hits.

A wide swath of the East, measuring several hundreds of miles, will get persistent gale-force winds in the 50 mph area, with some areas closer to storm landfall getting closer to 70 mph, said James Franklin, forecast chief for the National Hurricane Center.

"It's going to be a long-lasting event, two to three days of impact for a lot of people," Franklin said. "Wind damage, widespread power outages, heavy rainfall, inland flooding and somebody is going to get a significant surge event."

That storm surge will only be magnified by the full moon this weekend to make it a "dangerous period," Uccellini said.

Last year's Hurricane Irene was a minimal hurricane that caused widespread damage as it moved north along the coast after making landfall in North Carolina. With catastrophic inland flooding in New Jersey, Massachusetts and Vermont, federal officials say Irene caused $15.8 billion in damage.

Sandy is "looking like a very serious storm that could be historic," said Jeff Masters, meteorology director of the forecasting service Weather Underground. "Mother Nature is not saying, 'Trick or treat.' It's just going to give tricks."

Government forecasters said there is a 90 percent chance ? up from 60 percent two days earlier ? that the East will get pounded.

Utilities are lining up out-of-state work crews and canceling employees' days off to deal with expected power outages. From county disaster chiefs to the federal government, emergency officials are warning the public to be prepared. And President Barack Obama was briefed aboard Air Force One.

Boat owners were yanking their vessels out of the water Friday at the Southside Marina in Point Pleasant Beach, N.J., about 60 miles south of New York City.

"We're taking them out as fast as we can," said marina employee Jim Martin.

Atlantic City's casinos made contingency plans in case they have to close, as they did for three days last year when Tropical Storm Irene approached.

Eastern states that saw outages that lasted for days after last year's freak Halloween snowstorm and Hurricane Irene are already pressuring power companies to be more ready this time.

Asked if he expected utilities to be more prepared, Massachusetts Gov. Deval Patrick responded: "They'd better be."

Jersey Central Power & Light, which was criticized for its response to Irene, notified employees to be ready for extended shifts. In Pennsylvania, PPL Corp. spokesman Michael Wood said, "We're in a much better place this year."

New York Mayor Michael Bloomberg on Thursday said the city was striking a tone of calm preparedness.

"What we are doing is we are taking the kind of precautions you should expect us to do, and I don't think anyone should panic," Bloomberg said. The city has opened an emergency situation room and activated its coastal storm plan.

Some have compared the tempest to the so-called Perfect Storm that struck off the coast of New England in 1991, but that one hit a less populated area. Nor is this one like last year's Halloween storm, which was merely an early snowfall.

"The Perfect Storm only did $200 million of damage and I'm thinking a billion" this time, Masters said. "Yeah, it will be worse."
